There is a very good IT/IP lawyer in melbourne by the name of Steve White, I'll have to dig out his details later tonight at home. He has helped me with alot of IP work and I think he's done the odd bit freebee work aswell...

One approach would be to request an information paper direct from the ACA
spelling out what "open source" wireless networks are and are not allowed to
do.
The ACA does publish information papers by request, but I'm not sure what
sort of power and influence the group requesting the paper must carry.
